1. Agreement to Terms

By accessing or using NexAppStudio's applications and services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use our Services.

These Terms apply to all visitors, users, and merchants who access or use our Services, including our Shopify applications and website at nexappstudio.com.

2. Description of Services

NexAppStudio provides Shopify applications designed to help merchants optimize their checkout experience, manage discounts, set order requirements, and customize their store functionality.

Our Services are provided through the Shopify App Store and are subject to Shopify's terms of service in addition to these Terms.

3. Account and Registration

To use our Services, you must:

• Have a valid Shopify store account
• Install our app through the Shopify App Store
• Provide accurate and complete information
• Maintain the security of your account credentials
• Be at least 18 years of age or the age of majority in your jurisdiction

You are responsible for all activities that occur under your account and must notify us immediately of any unauthorized use.

4. Subscription and Payment

4.1 Pricing

Our apps may be offered on a free, freemium, or paid subscription basis. Pricing details are available on the Shopify App Store listing for each application.

4.2 Billing

Payments are processed through Shopify's billing system. By subscribing to a paid plan, you authorize Shopify to charge your payment method on a recurring basis according to the billing cycle of your chosen plan.

4.3 Free Trials

We may offer free trial periods for certain apps. At the end of the trial period, you will be automatically charged for the subscription unless you cancel before the trial ends.

4.4 Refunds

5. Acceptable Use

You agree not to use our Services to:

• Violate any applicable laws or regulations
• Infringe on the intellectual property rights of others
• Transmit malicious code, viruses, or harmful data

• Use automated systems to access our Services without permission
• Engage in fraudulent or deceptive practices

6. Intellectual Property

We do not warrant that our Services will be uninterrupted, error-free, or completely secure. We do not guarantee any specific results from using our Services.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEXAPPSTUDIO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OUR SERVICES.

Our total liability for any claims arising under these Terms shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless NexAppStudio and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of our Services, your violation of these Terms, or your violation of any rights of a third party.

You may terminate your use of our Services at any time by uninstalling our app from your Shopify store.

We reserve the right to suspend or terminate your access to our Services at any time, with or without cause, and with or without notice. Reasons for termination may include:

• Non-payment of fees
• Fraudulent or illegal activity
• Request by law enforcement or government agencies
• Discontinuation of the Services

12. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of our Services after such modifications constitutes your acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which NexAppStudio operates, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of that jurisdiction.
